
An Interstate Household Goods Tariff is a legal document that must be published by every interstate household goods motor carrier. The tariff specifies the exact prices, rules, regulations, and services offered to the public. The Interstate Household Goods Tariff Package to be created on behalf of MOTOR CARRIER, which will contain the following parts and optional services:
1. Custom written interstate tariff reflecting the terms of MOTOR CARRIER’s services.
2. The design and licensed use of an interstate Bill of Lading.
3. The design and licensed use of an interstate Valuation Addendum.
4. The design and licensed use of an interstate packing materials order form.
5. The design and licensed use on an interstate Revised Estimate form.
6. The design and licensed use of a Post Contract Services form.
7. Participation in a Neutral Arbitration Program. (Fees to arbitrator not included).
Please also note that certain services are not included. Those services include by are not limited to the following:
• The booklet entitled “Your Rights and Responsibilities When You Move.”
• The inventory logs.
• Any printing of any contracts/documents.
• Anything not specifically listed in Section 2.A. of this agreement.
Scope of Service:
limited use of shipping documents, and acknowledgement of copyright: Engagement in this agreement is for consulting services and does not expressly create an attorney client relationship or legal services. Motor Carrier acknowledges and agrees that the shipping documents created as listed in section 2.A. of this agreement is for the licensed use of the shipping documents only. Motor Carrier by and through this agreement agrees to the licensed use of the shipping documents for company named above and for no other company owned or directed by Motor Carrier. This agreement is for the limited licensed use of the shipping documents and confers no ownership rights of the copyright to the shipping documents.
Limitation of Liability:
Moving Claims does not provide legal services and does not warrant that the contents Interstate Tariff and drafted shipping documents shall be in full compliance with the FMCSA and STB regulations. Since Moving Claims cannot control how the tariff and documents are used and maintained by the motor carrier; a motor carrier’s use of the tariff and shipping documents which is not in compliance with the FMCSA or DOT regulations voids all warranties, expressed or implied.
Severability, Changes, Modifications, Entire Agreement, Right of Refusal:
If any part of this contract is found to be unlawful or invalid, the remaining terms and conditions shall still be enforceable. This agreement constitutes an entire agreement. No alterations, modifications, addendums, or changes can be made without the express written consent of both parties. No other agreement, written or otherwise will affect the terms and conditions of this agreement. Moving Claims, or any of its agents, shall have the right to refuse service no person or company without cause or explanation.
Mandatory Arbitration:
All legal claims concerning this agreement or performance therein are required as mandatory to be submitted through Arbitration, through MovingAID.net. Each party is responsible for their own costs associated with arbitration. A benefit to the arbitration alternative may be that it is less expensive than traditional litigation. Each party is responsible for 50% of the costs associated with securing the arbitrator and 100% of their own expenses, including but not limited to attorney fees. If the arbitration alternative is chosen, then any decision made by the arbitrator may be binding. Additionally, an arbitration decision may not be appealed in a court of law.
Entire Agreement and Confidentiality:
- This AGREEMENT contains the entire agreement between the parties and may not be altered or amended or modified, except in writing and signed by both parties.
- Confidentiality: Both parties agree to hold as confidential all events, transactions, circumstances, agreements, terms and conditions, and actions of either party.
